Welcome to Miodus Hotshotting and Hauling LLC. By requesting a quote, scheduling a service, accepting a service agreement, submitting a contact form, or using our hauling services, you agree to the following Terms and Conditions. These terms are intended to clearly explain how our services operate, what customers can expect, and what responsibilities apply to both the customer and Miodus Hotshotting and Hauling LLC.
1. Services Provided
Miodus Hotshotting and Hauling LLC provides hotshot hauling, local delivery, miscellaneous hauling, material transport, equipment transport, and other related hauling services. Services may include, but are not limited to, transporting materials, supplies, small equipment, tools, parts, freight, and other approved items.
All services are subject to availability, equipment capability, legal transport limits, insurance coverage, weather conditions, road conditions, and the specific details of each job. We reserve the right to accept or decline any job at our discretion.
2. Quotes and Estimates
All quotes and estimates are based on the information provided by the customer at the time of the request. This may include pickup location, delivery location, item description, estimated weight, dimensions, loading requirements, unloading requirements, timing, accessibility, and other job details.
Quotes may change if the information provided is inaccurate, incomplete, or changes before or during the job. Additional charges may apply for extra mileage, wait time, difficult access, oversized items, overweight items, added stops, special handling, delays, tolls, parking fees, loading or unloading assistance, or any additional services not included in the original quote.
A quote is not considered final until it has been reviewed and accepted by Miodus Hotshotting and Hauling LLC.
3. Scheduling and Availability
Miodus Hotshotting and Hauling LLC operates by appointment and availability. During the months of May through August, weekday availability is generally limited to after 4:00 PM, with more availability on weekends. During winter months, availability may be limited, but certain jobs may still be considered depending on timing, location, weather, and job requirements.
Scheduling is not guaranteed until confirmed by Miodus Hotshotting and Hauling LLC. We make every effort to arrive on time and complete jobs as scheduled, but delays may occur due to traffic, weather, road conditions, equipment issues, previous job delays, customer delays, or circumstances outside of our control.
4. Customer Responsibilities
The customer is responsible for providing accurate and complete information about the hauling job. This includes, but is not limited to:
A clear description of the item or load being hauled
Accurate pickup and delivery addresses
Approximate weight and dimensions
Photos of the item or load when requested
Details about loading and unloading conditions
Information about access roads, driveways, gates, low wires, soft ground, mud, hills, stairs, tight spaces, or other obstacles
Any special handling requirements
Whether loading or unloading equipment or assistance will be available
The customer is responsible for ensuring that the items being hauled are ready for pickup at the scheduled time unless otherwise agreed. If the item is not ready, additional wait time, rescheduling fees, or cancellation charges may apply.
5. Loading and Unloading
Unless specifically agreed in advance, the customer is responsible for ensuring that proper loading and unloading assistance, equipment, or machinery is available when needed. This may include forklifts, loaders, skid steers, ramps, additional labor, or other equipment necessary to safely load or unload the item.
Miodus Hotshotting and Hauling LLC reserves the right to refuse loading or unloading if conditions are unsafe, if the item cannot be safely secured, if the load exceeds equipment capacity, or if the job is different from what was originally described.
If loading or unloading requires additional time, labor, equipment, or special handling, additional fees may apply.
6. Load Securement and Safety
Safety is a top priority. Miodus Hotshotting and Hauling LLC will make reasonable efforts to properly secure loads using appropriate equipment and methods. However, the customer is responsible for accurately describing the item or load so that proper hauling arrangements can be made.
We reserve the right to refuse transport of any item that cannot be safely loaded, secured, transported, or delivered. This includes items that are unstable, improperly packaged, overweight, oversized, unsafe, illegal to transport, or not suitable for our available equipment.
7. Prohibited Items
Miodus Hotshotting and Hauling LLC does not transport illegal, hazardous, restricted, or unsafe materials unless specifically authorized and legally permitted. Prohibited items may include, but are not limited to:
Illegal substances
Hazardous materials
Explosives
Firearms or ammunition
Flammable liquids or gases
Biohazard materials
Live animals
Stolen property
Items requiring special permits, licensing, or certifications not held by the company
Any item that cannot be legally or safely transported
We reserve the right to refuse any load for any reason, especially if the load appears unsafe, illegal, misrepresented, or outside the scope of our services.
8. Cancellations and Rescheduling
Customers are asked to provide as much notice as possible when canceling or rescheduling a job. Cancellations made after a job has already been scheduled, dispatched, or started may be subject to a cancellation fee.
If Miodus Hotshotting and Hauling LLC must cancel or reschedule due to weather, equipment issues, unsafe conditions, emergency circumstances, or other factors outside our control, we will make reasonable efforts to notify the customer and reschedule when possible.
Repeated cancellations, missed appointments, or failure to provide access to the pickup or delivery location may result in refusal of future service.
9. Payment Terms
Payment terms will be discussed and agreed upon before service is completed. Payment may be due before pickup, at delivery, or upon completion of the job, depending on the type of service and agreement made.
Accepted payment methods may include cash and/or check. Unpaid invoices may result in additional fees and collection action.
Invoices not paid by the agreed due date may be subject to late fees. Customers are responsible for all costs associated with collecting unpaid balances, including collection fees, court costs, attorney fees, and other related expenses where allowed by law.
10. Additional Fees
Additional fees may apply for circumstances not included in the original quote. These may include, but are not limited to:
Additional mileage
Extra stops
Wait time
Tolls
Parking fees
Fuel surcharge
Difficult access
Loading or unloading delays
Oversized or overweight loads
Special handling
Rescheduling after arrival
Customer-caused delays
Failed pickup or delivery attempts
Any additional fees will be explained to the customer whenever possible.
11. Damage, Loss, and Liability
Miodus Hotshotting and Hauling LLC takes care when handling and transporting customer property. However, hauling involves risk, and the company is not responsible for damage caused by inaccurate customer information, improper packaging, pre-existing damage, hidden defects, weak or fragile materials, unsecured internal contents, weather exposure, road conditions, or loading/unloading performed by the customer or third parties.
Customers are encouraged to disclose fragile, valuable, delicate, or unusual items before scheduling service. Photos may be taken before, during, and after transport for documentation purposes.
Claims for damage or loss must be reported in writing as soon as possible after delivery. The customer may be required to provide photos, proof of value, receipts, repair estimates, and other documentation. Miodus Hotshotting and Hauling LLC reserves the right to inspect the item and investigate any claim before accepting responsibility.
The company’s liability, if any, may be limited to the amount allowed under applicable law, insurance coverage, written agreement, or the amount paid for the service, whichever is less.
12. Weather and Road Conditions
Services may be delayed, rescheduled, or canceled due to unsafe weather or road conditions. This may include snow, ice, heavy rain, flooding, high winds, severe storms, poor visibility, road closures, or other hazardous conditions.
Miodus Hotshotting and Hauling LLC reserves the right to determine whether conditions are safe for hauling. Customer deadlines do not override safety concerns.
13. Access to Pickup and Delivery Locations
The customer is responsible for ensuring safe and legal access to all pickup and delivery locations. This includes driveways, roads, parking areas, loading zones, job sites, and private property.
The customer must disclose any access concerns before service begins, including narrow roads, steep driveways, low tree limbs, soft ground, mud, snow, ice, low wires, weight-restricted roads or bridges, gated access, or limited turnaround space.
Miodus Hotshotting and Hauling LLC is not responsible for delays, property damage, towing, recovery costs, or inability to complete service caused by unsafe, restricted, or undisclosed access conditions.
14. Permits and Legal Requirements
Certain loads may require permits, special routing, special equipment, or legal authorization. Miodus Hotshotting and Hauling LLC reserves the right to decline any job that requires permits, licenses, insurance, or equipment not currently available.
The customer is responsible for accurately identifying the load and any special requirements known to them. If additional legal requirements are discovered after scheduling, the job may be canceled, rescheduled, or repriced.
15. Customer Property and Personal Belongings
Customers are responsible for removing personal belongings, loose items, valuables, and fragile contents from items being transported unless otherwise agreed. Miodus Hotshotting and Hauling LLC is not responsible for loose contents, hidden items, personal belongings, or valuables left inside equipment, containers, vehicles, boxes, or other transported items.
16. Photos and Documentation
Miodus Hotshotting and Hauling LLC may take photos or videos of loads, pickup locations, delivery locations, securement methods, and completed jobs for documentation, safety, proof of condition, and business records.
Photos may also be used for marketing purposes, such as website or social media posts, unless the customer specifically requests otherwise. Personal information, addresses, and sensitive details will not be intentionally shared.
17. Communication
Customers are responsible for providing accurate contact information and remaining available by phone, text, or email during the scheduled service window. Delays caused by inability to reach the customer may result in additional fees or rescheduling.
Miodus Hotshotting and Hauling LLC will make reasonable efforts to communicate job updates, delays, questions, or issues as needed.
18. Refusal of Service
Miodus Hotshotting and Hauling LLC reserves the right to refuse or cancel service at any time if:
The load is unsafe
The load was misrepresented
The item exceeds equipment capacity
The customer fails to provide accurate information
The pickup or delivery location is unsafe or inaccessible
Payment is not arranged as agreed
The customer behaves in a threatening, abusive, or inappropriate manner
The job involves illegal, restricted, or prohibited items
Weather, road, or equipment conditions make the job unsafe
19. No Guarantee of Delivery Time
While we make every effort to complete services in a timely manner, delivery times are estimates only unless specifically agreed in writing. Miodus Hotshotting and Hauling LLC is not responsible for losses, damages, lost profits, missed deadlines, job site delays, or other costs caused by delays outside of our reasonable control.
20. Website Use
The information on this website is provided for general informational purposes. Submitting a form, requesting a quote, or contacting us through the website does not guarantee service, pricing, scheduling, or acceptance of a job.
Users agree not to misuse the website, submit false information, attempt unauthorized access, or use the website for unlawful purposes.
21. Privacy
Customer information provided through the website, phone, email, text, or other communication methods may be used to provide quotes, schedule services, complete jobs, process payments, maintain records, and communicate with the customer.
